You may be eligible to make a refugee claim in Canada if you fear persecution based on race, religion, nationality, political opinion, or membership in a particular social group; face a risk of torture; or face a risk to your life or cruel and unusual punishment.
How to Make a Refugee Claim
- Make your claim at a port of entry (airport, land border) or at an IRCC office inside Canada
- Complete the Basis of Claim (BOC) form explaining why you need protection
- Attend your hearing before the Refugee Protection Division (RPD)
- If refused, you may appeal to the Refugee Appeal Division (RAD)
- Accepted claimants can apply for permanent residence as protected persons
Your Rights While Your Claim is Pending
While your refugee claim is being processed, you have the right to a work permit, access to health care through the Interim Federal Health Program (IFHP), and legal representation. You cannot be removed from Canada while your claim is under review.
